Session Summary: This session will explore the current U.S. Supreme Court cases that may impact individual and institutional investors' rights. The current docket started off with a bang and may end with a sputter. It includes cases that directly impact your portfolio on issues related to conflicts of interest, regulatory authority to return funds to injured consumers and the import of now ubiquitous arbitration clauses. This session is from the September 2021 conference. Some content may be dated.

Instructors

Peter Borkon

Mr. Borkon is a partner at Bleichmar Fonti & Auld’s Oakland, California office. His complex civil litigation practice is focused on corporate governance, ESG and securities suits as well as financial fraud and antitrust class actions. In addition to his litigation practice, Mr. Borkon provides extensive educational opportunities to BFA’s institutional investor clients. He has also served as an Adjunct Professor at the University of California Hastings College of Law, and is a Judge Pro Tem in San Francisco County.He is active in numerous community and professional organizations, including service on the Market Advisory Council for the Council of Institutional Investors (CII), Michigan Association of Public Employee Retirement Systems (MAPERS), State Association of County Retirement Systems (SACRS), California Association of Public Retirement Systems (CALAPRS), Illinois Public Pension Fund Association (IPPFA), National Council on Teacher Retirement (NCTR), and the National Association of Public Pension Attorneys (NAPPA) where he is the past Chair of the SEC Actions working group. He is also a longtime member of the National Conference on Public Employee Retirement Systems (NCPERS). He was recently reappointed for a third three-year term to the U.S. District Court’s Federal Practice Program Board, recently served as a Co-Chair of the Northern District of California’s Lawyer Representatives Committee and is currently serving on the Ninth Circuit Court of Appeals, Circuit Executive Committee. Mr. Borkon was named a Northern California Rising Star in 2010 and 2011, and a “Super Lawyer” in 2012, 2015 – 2021 by Super Lawyers Magazine.
