Fiduciaries' Role in Securities Litigation Strategy

Session Summary: Plan trustees play a critical role in administering pension plans. In the context of securities class action litigation, trustees (i.e., fiduciaries) evaluate several potential courses of action, including active pursuit of lead plaintiff status in pending cases. This session discusses the factors trustees should consider when making the important choice of selecting a securities litigation strategy on behalf of a pension plan.

Andrea Farah

Andrea Farah is a senior litigation attorney who focuses her practice on securities fraud, commodities manipulation, and antitrust litigation. Ms. Farah has litigated prominent securities cases with novel and complex claims relating to a variety of financial instruments in which she secured notable monetary recoveries on behalf of investors, including, for example, a $386.5 million settlement in In re GSE Bonds Antitrust Litigation. Additionally, Ms. Farah litigates several consumer class action lawsuits with large recoveries for consumers, including a most recently obtained settlement of $95 million in a consumer case against Apple, Inc. Ms. Farah leads the securities monitoring team at Lowey Dannenberg and identifies securities litigation opportunities for private and institutional clients. She is a frequent speaker at industry conferences and academic events and a publisher of articles relating to securities litigation. Ms. Farah is a graduate of the Quinnipiac University School of Law and the School of Business. Ms. Farah is licensed to practice in the States of New York and Connecticut. Ms. Farah was named a Rising Star in the securities practice area since 2019.

Robert Killorin, CRPF™

Robert W. Killorin is a Partner at Faruqi & Faruqi, LLP’s Atlanta Office and is a member of the firm's Institutional Investor Practice Group and Co-Chair of the firm's Securities Litigation Practice Group. His practice is focused on shareholder merger and securities litigation. Mr. Killorin is an accomplished trial lawyer with over twenty years of experience in civil litigation. Mr. Killorin has represented numerous individual plaintiffs, as well as institutional pension funds, corporations and individual investors in courts around the country. He has obtained significant recoveries, including the following securities class actions: In re FireEye, Inc. Sec. Litig., No. 14-266866 ($10 million settlement pending); In re ArthroCare Sec. Litig.
